Shakti Mills gang-rape case: Draft charges submitted

MUMBAI: The prosecution in the Shakti Mills gang-rape case of a photojournalist on Thursday submitted the draft charges against four of the accused. Principal judge Shalini Phansalkar Joshi will only frame the charges against the accused after the defence presents its arguments on Friday.

Special public prosecutor Ujjawal Nikam submitted the eight-page document elaborating the 12 charges that should be framed against Vijay Jadhav, Siraj Khan, Kasim Shaikh and Salim Ansari. A few of the charges also included parts of the newly added sections in the Indian Penal Code.

"Mumbai was rocked on August 22 after a photojournalist was gang-raped in the dilapidated premises. The act was dastardly. It was a merciless incident and I have no adjectives to explain this gruesome act. The accused operated inside a dilapidated structure of Shakti Mills, targeted women and sexually assaulted them," Nikam said, while opening the case in court. "Shakti Mills witnessed the gang rape of two girls in 20-22 days."

The proceedings were to commence at 12pm, but were delayed as the accused were brought to court at 2.30pm.

The charges include Section 120 (B) (criminal conspiracy), Section 376- D (where a woman is raped by one or more persons constituting a group or acting in furtherance of a common intention, each of those persons shall be deemed to have committed the offence of rape), Section 377 (unnatural sexual offences) section 354 (A) (iii) r/w 376 (showing pornography against the will of a woman and committing rape), Section 354 (B) r/w 120 (B) (criminal conspiracy to compel a woman to disrobe), sections 341 and 342 r/w section 120 B (criminal conspiracy to wrongfully restrain and confine) sections 323 and 506 (2) r/w 120 B (criminal conspiracy to wrongfully cause hurt and criminal intimidation) and Section 201 r/w 120 (B) (criminal conspiracy to destroy evidence).

After the charges are framed, the trial will commence in the photojournalist's alleged gang-rape case.

Nikam also told the court that the second case in which a call centre employee was gang-raped on July 31, by five men, including three of the accused in the photojournalist's case, will be opened after material evidence is submitted before the same court. The chargesheet in the call centre employee's case against Jadhav, Shaikh, Ansari and Ashfaq Ahmed was filed on Tuesday.
