In June, the police had informed the HC that it would file a closure report as there was no proof of the allegation being either true or false. The report has yet to be accepted by the judge.
The closure report, which was filed in a case against Ajay and his late mother Madhuri Mafatlal, said the investigation has shown that Sheetal "wrongly stated that injury on her arm was caused by Ajay and that looking at the physical condition of Madhuri Mafatlal it is doubtful she would assault Sheetal on her head with a stick in July 2011". The report said that "it is clear that the situation is created by a misunderstanding" and sought permission to classify the case as closed. Since her demise, the case against Madhuri stands abated. Police said that "there is no reasonable proof to file a chargesheet against the two".
On Thursday, as magistrate Uday Ahire was not presiding over matters, his staff gave the next date after Sheetal's lawyer sought time on the grounds that she wished to oppose the closure report. The court also handed over a copy of the B-Summary closure report, which seeks to close another FIR filed by Sheetal as being false. She claimed that three people had stolen her valuable paintings and replaced them with fakes.
In August 2011, Ajay and his mother had moved the HC seeking to quash the criminal case. Sheetal had filed the FIR against others, too, including her husband Atulya in August 2011, but on his written apology, the case against him, his children from his first wife and one of his sisters was dropped by her after filing of consent terms. Last November, the HC had allowed the police to investigate the FIR against Madhuri but had directed the police not to file a chargesheet in the case without further orders.
According to both the mother and son, Atulya and his second wife Sheetal "deliberately made allegations against each other as part of a larger conspiracy to drag them into unwarranted criminal cases which they otherwise couldn't have since the family had distanced itself from the couple through civil litigation". Last August, Atulya, through his daughter Marushka from his first wife Payal, accused Sheetal of stealing nearly 40 paintings of famous artists. Later, Sheetal accused Atulya and his family of treating her with cruelty and harassment since 2004.
