MUMBAI: The defence in the 2010 Kurla rape and murder case of a minor filed an application before the principal judge alleging that the accused feared that he was not getting a fair trial. The defence said that the judge was expected to hear the application on Monday.

One of the most shocking cases in recent times was of the nine-year-old girl found murdered and raped in Kurla's Nehru Nagar in 2010, for which a cable operator's employee Javed Shaikh was arrested. Trial commenced in September 2010 and so far the prosecution has examined 26 witnesses.

The court had framed charges against Sheikh under section 302(murder), 363(kidnap) and 376 (rape) of the IPC. Shaikh pleaded not guilty on all three counts. The Nehru Nagar police filed a 325-page chargesheet against the accused and has relied on statements of 45 witnesses.
