Railway Board to tell HC if elderly will get compartment in Mumbai locals

MUMBAI: The Railway Board's response to proposals of the Central and Western Railways for providing separate for providing a separate compartment for senior citizens on the suburban trains in Mumbai will be told to the Bombay High Court today.

The court's direction was on a suo motu PIL which was converted out of a letter written by A B Thakker urging reservation of a separate compartment for senior citizens. WR replied that it is not possible to provide a separate compartment as it will only cut into space of the second class commuters and already there are separate compartments for women, disabled and luggage. The bench of Justice Abhay Oka and Justice A S Chandurkar at the previous hearing on June 27 was informed by WR's advocate that the Board has twice has rejected its proposal for a separate compartment for senior citizens.

Amicus curiae advocate M S Karnik's argued that WR's affidavit "proceeds on the footing that the maximum passengers are office-going passengers and therefore below retirement age and not senior citizens." Karnik said due to financial crunch senior citizens are required to take up some employment. The bench then remarked that the affidavit displays "non-application of mind" and that senior officials of the railways who never travel on the suburban trains can never know the plight of senior citizens.

The Ministry of Social Justice and Empowerment in its July 22, 2014 reply said senior citizens face similar problems as persons with disabilities, and therefore, provision for dedicated/special coaches/compartments should be made available for them. The judges directed WR and CR to submit a fresh proposal within a week and directed the Board take a decision thereafter within two months.
