The court, hearing a public interest litigation on November 7, had rapped the government asking why it issues fresh licenses every year to organisers of religious festivals who flout noise pollution norms on the permissible noise levels.
"If there was a breach earlier, still you grant licenses the next year?'' asked a division bench of Justice Abhay Oka and Justice A S Gadkari while hearing a new plea in a pending public interest litigation for direction to organisers to file undertakings to abide by the Noise Pollution Rules, to deposit a substantial sum to be forfeited in case of a breach and to prohibit loudspeakers in public places.
The PIL was filed by Dr Mahesh Bedekar who runs a hospital in Thane on the menace of noise pollution in Thane. His application said despite the police commissioner taking steps various political leaders have issued public statements against implementation of the noise pollution rules and the court's orders. The court expanded the scope of the PIL to cover all civic bodies in Maharashtra. On October 2, the court had asked the government if it has a policy to grant of permission in silence zones.
At the November 7 hearing, the government's advocate sought a short adjournment to finalise its reply.
