HC directs fresh hearing on deemed conveyance for Campa Cola society

MUMBAI: Bombay high court on Tuesday set aside the deemed conveyance granted to Campa Cola societies and remanded the matter to the deputy registrar of cooperative societies for a fresh hearing.

Justice RM Savant heard a petition by Brihanmumbai Municipal Corporation challenging the December 17, 2013 order granting unilateral deemed conveyance of the land to the societies contending that being the owner of the land it was not heard.

The societies' senior advocate Prasad Dhakephalkar informed the court that his clients have no objection to the impugned order being set aside and the matter remanded for a de novo hearing.

Further that they also have no objection to making BMC a party to the proceedings.

Setting aside the December 17, 2014 order, Justice Sawant directed the conpetent authority — the deputy registrar — to hear and decide the societies' application for deemed conveyance latest by Sept 4, 2014.
