MUMBAI: Two years after he cut down a promising life in its prime, security guard Sajjad Pathan, 24, was convicted by a special women's court on Monday of murdering advocate Pallavi Purkayastha, 25, in her flat in a Wadala highrise. Pathan, in his alleged confessional statement, told cops that he killed Pallavi with a knife after she fought him when he tried to force himself on her.

"All offences have been proven against the accused," ruled judge Vrushali Joshi in a packed courtroom in the presence of Pallavi's parents Atanu and Sumita, both senior bureaucrats, before adjourning the matter to Thursday for arguments on the quantum of sentence.

Speaking to TOI after the verdict, Pallavi's parents said they expected "nothing but the death sentence".

Pathan stood expressionless as he was informed in Hindi that he had been found guilty of murder, outraging the modesty of a woman and trespassing.

As he feebly started to say he had done no wrong, the judge told him he could have his say on Thursday.

Dr Alok Sengupta, father of Pallavi's live-in partner Avik, who was the complainant in the case and passed away last year, said his son had been awaiting the verdict till the end. "It is justice for both of them," he said from Jamshedpur. The family has been keeping tabs on the case, said Pallavi's mother after the proceedings.

The prosecution proved that Pathan, driven by his lust, kept switching off the power to Pallavi's flat after she returned home around 11.30pm on August 8. Pallavi, a legal adviser with actor Farhan Akhtar's Excel Entertainment, called Avik, who was still at work, and was advised to seek help from the Himalayan Heights watchmen as he would not be back soon. Pathan came with an electrician and while he was running a check, Pathan stole the flats keys. Later, armed with a knife, he let himself into the flat and tried to force himself on a sleeping Pallavi. The gutsy woman fought him tooth and nail till he slashed her throat. Blood stains showed she had tried to get help from neighbours, but failed. Avik found her dead in the bedroom when he returned in the wee hours.

Pathan was not accompanied by anybody. "My family is expected to arrive from Kashmir any time now. It is a long way off and it is not easy for them to travel the distance," he said outside the courtroom on Monday. "I never even looked at her (Pallavi)," he added.

He had been arrested from Mumbai Central as he was planning to flee the city a day after the murder. His colleagues had alerted the police.

On Thursday, special public prosecutor Ujjawal Nikam and defence advocate Wahab Khan will present arguments on the quantum of sentence. Nikam said it was undecided if he would seek the death penalty. The defence said death penalty was not applicable as the "rarest of rare" condition was not fulfilled.

"It was a big challenge as there was no direct evidence against the accused," said Nikam. "The case rested on circumstantial evidence and we relied on various small evidences to complete the chain of circumstances and establish the guilt of the accused."

The trial began on May 8 last year, with Avik deposing as the first witness. He told the court that Pallavi, whom he was to marry soon, had told him Pathan used to stare at her. "I told her she was a pretty girl and to just ignore Pathan," he had said. Avik passed away last year after suffering from an inflammatory brain disorder. Cops probing the case said he was in deep depression.

A total of 39 prosecution witnesses and two defences deposed. The sexual assault charges were not added in the chargesheet, but were part of the draft charges submitted before the court later.

The case took a controversial turn during the final arguments earlier this month, when the defence claimed Avik could have been involved in the murder and Pathan was being made a scapegoat.
