As reported by TOI on Friday, a prime Prabhadevi plot has been virtually excluded from CRZ after a new rule reduced the minimum distance for constructions near a bay from 500m to 100m.
Developer Sunil Mantri said 202 sq km, or under half of Mumbai's land area, has been affected by CRZ. "This includes the redevelopment of 2,500 dilapidated buildings and 60 slum pockets near the coast. It is time to revisit CRZ laws framed in 1991 and relax them,'' he said.
Anuj Puri, head of global property consultant Jones Lang LaSalle India, said the new definition comes as a clear-cut direction, unlike earlier when development in the CRZ was in limbo. "It will release a fair amount of land for development, mainly for premium residential projects,'' he said.
Housing activist Chandrashekhar Prabhu said areas like Chowpatty, Cuffe Parade, Churchgate and parts of Malad would also be treated as 'bays' now. "There will be no seafront left in Mumbai. Where will we draw the line? We might as well remove CRZ norms completely,'' he said, adding that it would only benefit developers.
Activist-lawyer Y P Singh said the Maharashtra Coastal Zone Management Authority's (MCZMA) definition was "patently illegal'' and done without statutory authority. "The power to make changes to the coastal zone classification is with the National Coastal Zone Management Authority and not with MCZMA. CRZ rules have been diluted for tenant and slum schemes. Such suspicious and nepotistic decisions will be very detrimental to the fragile coastal environment of Mumbai. The environment ministry and national coastal authority must intervene,'' he said.
Debi Goenka of Conservation Action Trust said MCZMA's redefinition was "scandalous". To cite an example, MCZMA felt that since the entire east coast of India was exposed to the Bay of Bengal, the entire east coast of India should be treated as a bay and the CRZ width could be consequently reduced to 100 metres for the entire east coast of India, Goenka said.
