The petition filed by NGO Vanshakti has sought that wherever constructions have been carried out and public access blocked, an opening be created to allow access.
The NGO, in its plea, said that there are advertisements wherein builders promise houses adjoining rivers, creeks, beaches and lakes.
"These builders, in the garb of fulfilling buyers' dreams ... destroy ecologically important and sensitive areas like areas bordering rivers/floodplain/seas etc." Most of these constructions are in the Mumbai Metropolitan Region. On the Kalyan-Shilphata road, two km of the river bank has been walled in for a housing project. At Vajreshwari, famous for its hot springs, a developer has fenced in bungalow plots along the river.These are in the geothermal area where the hot springs are located, states the petition. Similarly resorts are being promoted along the Vaitarna and Ulhas river.
The petition has pointed out that the construction of walls on river banks has an adverse impact on the ecological system as it drains and prevents recharge of ground water, causes flood and results in land erosion. "In a number of areas constructions is being carried out in the flood plain. This construction in the river banks has affected the natural flow of streams and rivers and has caused environmental problems besides increasing the risk to human life and property in other areas. Constructions are being carried out on the flood plain zone resulting in constriction of river banks and obstruction of river flow." It has warned that situation similar to that which led to the floods in Uttarakhand are being created.
It has sought that the area of the river and the flood plain be demarcated and no construction of any kind be allowed in the buffer zone of the flood plain.
