A division bench of Justice Abhay Oka and Justice A S Chandurkar directed that they shall state whether they are willing to file similar undertaking like those given by Nationalist Congress Party and the Bhartiya Janata Party not to allow or encourage their party workers to put up illegal posters, banner and hoardings and shall cooperate with the civic staff and not cause obstruction for their removal.
The judges heard a clutch of public interest litigation on civic inaction in removing the illegal banners and hoardings across Maharashtra. The aforementioned parties including Bahujan Samaj Party and Republican Party of India (Ramdas Athavale faction) were added as parties following the court's direction to implead them. Private notices were sent to these parties.
The court noted that while RPI (Athavale) did come before the court and agreed to file an undertaking, it eventually did not show up. Congress, Shiv Sena and MNS did not represent themselves in court. The judges have also issued comprehensive interim directions including pinning of responsibility by appointing nodal officers, for setting up toll free numbers for anonymous citizens complaints and the police to give protection and help to the civic squad.
