Global report ranks India poorly on rule of law

MUMBAI: The rule of law has repeatedly come in for question in India in recent times after anti-corruption campaigns seized public imagination.

More recently, the Supreme Court raised concerns over curtailment of the freedom of expression following Mumbai police arrests under Section 66 A of the Information Technology Act. A new global report that studies the rule of law across 97 countries deals a further blow, ranking India at a lowly 83 for rampant corruption, 79 for its regulatory environment and 78 for its civil justice systems.

The 'Rule of Law Index 2012' report, which has come up with the findings is a quantitative assessment drawn up by the World Justice Project to analyse to what extent countries adhere to the rule of law in practice. It looks at 48 indicators across nine concepts such as absence of corruption, fundamental rights, open government, limited government power and criminal and civil justice systems among others. It essentially evaluates day-to-day concerns such as whether citizens can access public services without bribing government officials, whether disputes can be resolved peacefully, and whether people live free of crime or police abuse.

The corruption indicators largely look at the extent to which government officials in the executive, police, judicial and legislative branch do not use public office for private gain. India emerged at a lowly 83, the laggard among the BRIC economies, figuring way behind China (ranked 40), Brazil (38) and even Russia which is at a lowly 71.

For a country proud of its democratic credentials it is unfortunate that India should lag behind on parameters of civil and criminal justice as well.

The Supreme Court has already asked the Centre and four states to explain their use of the IT law. But the report should serve as a wake up call.
