MUMBAI: Bombay High Court on Monday extended by three months the tenure of the one man commission probing illegalities in the allotment of flats under the chief minister's discretionary quota.

The court also extended by five and eight weeks respectively the time for Urban Development Department and Maharasthra Housing and Area Development Authority to submit files to retired HC judge J A Patil. The commission is based in Pune.

On October 9, the court appointed Patil to probe flats allotted under 2 percent under MHADA and 5 percent under Urban Land Ceiling from 1982. The tenure was fixed from December 1, 2014 to April 30, 2015. Last week the Commission informed the court that the Housing Department has submitted only 500 out of 1300 files and the Urban Development Department only 314 out of 12000 files. Both departments filed affidavits saying the delay is due to searching of records and creating files of individual allottees and urged more time to submit the files.

The bench of Justice Abhay Oka and Justice Anil Menon noted that as a result of the delay on part of the State government, the time granted to the committee will have to be extended. They directed its tenure to be extended till July 31 and also that the government issue a government resolution in this regard within three weeks.
The judges warned that if the State government ''fails to extend necessary cooperation within the time stipulated, the matter will have to be viewed very seriously.'' The bench granted the commission liberty to approach the HC's registry if the files are not submitted so that the matter can be placed before it ''for necessary directions.'' development department,CM quota inquiry,Bombay high court
