Search committee to reconsider Mumbai VC's eligibility: HC

MUMBAI: Bombay High Court on Wednesday directed that a search committee, comprising experts, shall reconsider Mumbai University vice-chancellor Rajan Welukar's eligibility with regard to fulfilment of an essential criteria. Welukar was appointed on July 7, 2010 for five years.

A division bench of Chief Justice Mohit Shah and Justice B P Colabawalla also directed that in case the committee decides that Welukar is not eligible for the office of vice-chancellor, the chancellor (the governor) shall pass consequential orders.

The court directed constitution of the search committee by the chancellor within two weeks. The committee shall thereafter take a decision within four weeks. When informed that members of earlier search committee have retired, the bench said it will be open to the chancellor to retain the same members or appoint new ones.

A reference bench on December 11, 2014 held that the search committee has displayed non-application vis a vis the criteria - that five (out of twelve) of his research publications are post PhD, peer-reviewed, published in international research journals and referred for study in higher education. The bench has also resultantly agreed that HC should in its extraordinary jurisdiction direct the search committee to to reconsider the question of eligibility of Welukar.

In August 2011 a division bench headed by the chief justice gave a split verdict by differing on the five research publicationss and subsequently a single judge could also not decide on it. Hence the reference to another division bench. After the December 2014 verdict of the reference bench, Welukar moved the bench seeking clarifications. His application was dismissed on February 5, 2015 as having no merit.
