Police registered the second case, lodged by the same complainant, just 30 minutes before the man, Abid Hussain, was to arrive at the police station on the HC's orders.Livid at the circumvention of the court orders, Justice Sadhna Jadhav directed deputy commissioner of police (zone 9) Satya Narayan Chaudhary to look into the conduct of the probe officer.
"It is apparent on the face of record that the investigating officer has been hand-inglove with the complainant.Only to bypass an order passed by this court granting in terim relief in favour of Hussain, (the officer) has attemp ted to register a fresh FIR and arrested him although (the officer) was fully aware that in a similar transaction, he (Hussain) has been protected by this court," Justice Jadhav said. The HC also pointed out that police had violated procedure by not sending a copy of the FIR to the magistrate and by detaining Hussain's family at the police station to secure his arrest.
"The high-handedness of the police officer is writ large on the face of record. The DCP, zone-9, shall personally look into the manner of the functioning of the investigating officer," the HC said, giving the DCP six weeks to conduct an inquiry and file a report in the court before the next hearing of the case on February 6. A 67-year-old selfproclaimed godman was arrested by the police on Monday for allegedly sexually assaulting a 17-year-old collegian.
The accused, Anil Bharate, has a large number of followers, said the police. The minor girl's aunt, who lives in Bharate's neighbourhood, is one of his followers. She had convinced the teenager's parents to send her to become Bharate's follower and dedicate herself to his service. The aunt told the girl's parents that Bharate would pay for her higher education.
The girl's parents got her admitted to a college in Virar, where Bharate lives in a two bedroom flat. Bharate asked the girl to stay with him in the flat. The girl, whose family resides in Charkop, lived there for a year.
An officer from the Charkop police station, where the girl's parents have lodged a complaint, said that Bharate had been abusing the girl over the last two months.
"He would insist that they should share a bed. He also touched her inappropriately," said a police officer, adding that unable to endure the frequent harassment anymore, the girl escaped.
She fled to her uncle's house in the western suburbs, as she thought that it would be easier to explain matters to him than to her parents.
"The helpless girl narrated to her uncle what she was be ing put through," said the po ice officer, adding that the uncle escorted the girl to the Charkop police station on Sunday .

Bharate has been booked or sexual assault under the Indian Penal Code, besides the Protection of Children from Sexual Offences Act. The girl was sent for a medical examination.
Bharate was taken into custody on Monday. A magistrate's court has remanded him in police custody till Tuesday.
Bharate told the police that he "did not have any worldly desires". Asked about the allegations made by the teenager, he said that it was a "part of his mission", said the officer.
Considering the "sensitive" nature of the case, the police investigation will be conducted by a woman officer. The police are also probing if any other girls had been harassed by Bharate.
Bharate has two daughters, who live in the US, while his son is in Nagpur. He has penned a couple of books.
