HC to direct BMC to provide water to illegal slum-dwellers

MUMBAI: Bombay High Court will pass an order today directing Brihanmumbai Municipal Corporation to provide water to slums which have come up after January 1, 2000, the cut-off date for slums with have been legalised.

The court has earlier clarified that it is not batting for illegal slums dwellers but providing water is integral to Article21 ( Right to Life) and cannot be denied to any person.

A division bench of Justice Abhay Oka and Justice A S Gadkari will pass their order on a public interest litigation filed by Pani Haq Samitito provide water to every resident of Mumbai. BMC has opposed the petition saying it will create difficulties for it. But the judges have said water cannot denied to slum-dwellers and questioned why the slums were allowed to come up in the first place.. The point is simple. If these slums are in existence, how can you deny them water?'' asked Justice Oka at the previous hearing on October 9, adding that even water is provided to buildings without no objection certificate.

The judges then said they will pass an order on October 11 directing BMC to work out scheme for water-supply with pre-paid cards without giving any equity to slum-dwellers.
