But sources said the crime branch is moving the Bombay high court against the sessions court's order. "We are studying the court order and forwarding it for legal opinion. Then we will take a call on opposing his bail application before a higher court," said a senior police officer. The police said they had strong evidence, including the complainant's statement, witnesses who have seen the accused and the complainant at the two scenes of crime, the CDRs of both, messages and emails, and other technical evidence.
Besides, the home department will also initiate a departmental inquiry against the DIG for misconduct. Paraskar, who is retire in two years, will not get a prime posting. "Paraskar went out of his way to remain friends with the woman, he has flouted civil service conduct rule," said another IPS officer.
Activists and senior officers do not seem to agree with the way the court commented on the merits of the case. "The judge should not have commented on the merits of the case. It would be decided at the time of trial if it was consensual," said Advocate Persis Sidhwa, part of NGO Majlis RAHAT programe. Echoing him, IPS officer-turned-advocate Y P Singh said, "Any observation in an order for bail, legally, cannot have any effect on an independent investigation and subsequent trial. But sometimes, cops get influenced by such comments. This also enhances the pitch of the defence of the accused."
