Security guard gets life term for Pallavi murder

MUMBAI: Sajjad Pathan, 24, was sentenced to life imprisonment on Monday for murdering young lawyer Pallavi Purkayashtha in 2012.

Denying the prosecution plea for death sentence, special judge Vrushali Joshi said: "The balance of the aggravating and mitigating circumstances shows that the case does not fall in the rarest of rare category. Under Section 302 (murder), the accused is sentenced to life imprisonment for the reminder of his life."

Pallavi's parents, senior bureaucrats Atanu and Sumita, expressed anguish over the verdict. Sumita broke down after the verdict was pronounced at 1.55pm. "If in the Shakti Mills rape case the accused can get death, then why wasn't it so in this murder case? Our fight does not end here. We will appeal in the Bombay high court," she said outside the court room.

Special public prosecutor Ujjwal Nikam said a decision on an appeal will be taken after the detailed judgment copy is made available. "There was no eyewitness in the case and it rested on circumstantial evidence. This sentencing will send a strong message to society," Nikam said.


After pronouncing the sentence, the judge summoned Pathan to the witness box and explained the charges and the corresponding sentences. While Pathan pleaded with the court to reduce the sentence, judge Joshi told him that life sentence was the minimum punishment for murder. "Everyone was asking for the death sentence. This is the least you could have got," she told him in Hindi.

Pathan, who had remained stoic throughout the 10-minute proceedings, broke down when he met his lawyer Wahab Khan outside the court. "My parents have not been informed so far. My mother is a heart patient and had fainted after she heard about my conviction last week," he told TOI. Asked if he was relieved on averting the death sentence, Pathan said: "I knew it was impossible for me to get death. When an accused was not given the death sentence after hacking a body into 300 pieces, why would I be given such a sentence?"

On June 30, the court had convicted Pathan for killing Pallavi in her rented flat in Wadala where she stayed with her fiance Avik Sengupta. On the morning of August 9, 2012, Avik, also an advocate, had found Pallavi's body after returning home from work.

In another tragic twist to the case, Avik himself died on November 14 last year after suffering from a brain disease.

Investigating officer Mahesh Tawde said the unwavering testimony of the witnesses helped clinch the case. "Especially witnesses from the same region as Pathan did not let their affinity come in the way of justice," Tawde said.

Pathan's fellow Kashmiri watchmen and a driver had told the police about his confession to them about the crime.
