Leading solicitor Subhash Kothari passes away

MUMBAI: Subhash Kothari, senior solicitor and partner at one of India's oldest law firms Kanga & Co passed away this week. His demise leaves a huge hole at the law firm established in 1890 where he headed a large and active litigation department as well as banking, finance and securitization matters.

The 70-year-old lawyer had a "no-nonsense and forthright attitude" said his peers. "He was an old-school advocate, who worked hard, had sound legal knowledge, strong work ethics and a sense of assurance that at once put clients at ease," said a young lawyer who had assisted him in matters.

Kothari was on a vacation in southern India with his wife Nilanjana when he developed a pain in his leg on May 19. By the time they reached Coimbatore the pain worsened and that afternoon was his last. His solicitor son Swapnil rushed with his wife and child to Coimbatore where the last rites were performed. "It is difficult to believe that he is no more. He was a giant in his field," said Swapnil. The Bombay HC had in 2008 appointed him as an amicus curiae (friend of court) in a complex matter, the first solicitor to be so appointed in several decades.

Shailsh Vaidya, partner at Kanga said— "He was my most respected senior, very kind hearted and had given me my initial legal training. I learnt all about bank documentation from him over which he had great mastery."

The law firm's managing partner, the eminent M L Bhakta, expressed grief at the sudden unexpected loss. "He was a senior partner and with the firm for over 40 years. I am the only partner senior to him. He was its pillar and one of the leading lawyers in the city who handled several important clients including the BCCL and trained many young lawyers in banking law. It is a big loss."

Senior counsel Veerendra Tulzapurkar who is vacationing in New Zealand learnt of the news from a weeping junior. His condolence message to Kothari's son Swapnil said, "I have known Subhash for the last 45 years. A true friend. He was always obliging to all. Particularly the junior members at the bar were helped by him." Senior and junior counsel at the Bombay high court bar alike considered him their mentor and remember him as a "large and warm hearted lawyer difficult to find."

His family will hold a prayer meeting for him on Saturday at Rangsharda Hall in Bandra (West) at 5pm.
