Brothers arrested for cheating bailed

MUMBAI: Brothers Rajeev Thakur and Ashish Thakur, arrested for allegedly selling a large plot worth Rs 800 crore without the knowledge of their partner, were released on conditional bail of Rs 3 lakh each on Friday. The 47th Metropolitan Magistrate court directed them to surrender their passports and report to the Economic offences wing (EOW) office twice in a week.

EOW officials have now written to the two banks asking them to furnish the bank's statements of all eight members of Thakur family as they had allegedly received Rs 3.95 crore from complainant.

Police last week arrested Rajeev Thakur (54) and brother Ashish Thakur (51) for criminal breach of trust, criminal conspiracy and for cheating Kanhaiya Motwani to tune of Rs 3.95 crore. Police told the court that while duo have admitted their crime but are trying to justify their act stating that they felt the MOU between them and Motowani was terminted as latter failed to start up the work within the 18 months time. "If this was the case than as per the MOU, Thakur family should have returned the money to Motwani and than should have proceeded to sell the plot to another builder," said police.

The cheating case pertains to a huge piece of land measuring 32,000 square yards on Andheri-Kurla road which was recently sold by the Thakurs to HDIL who in turn has sold to Kanakia Builders for Rs 800 crores in 2011. Kanhaiya Motwani, lodged a complaint saying that Kishanchand Thakur, father of the arrested accused had allegedly sold the land to him in 1994. As per the MOU they had decided to jointly develop the property. Motwani learnt about the sale only recently though they have been issuing public notices advising/warning people against getting into any transaction of the said plot, police said.

"As per the MOU, Motwani, paid Rs 3.95 crore in installments by cheque to Thakur family in the period 1995 to 2006. Some of the payments were made after Kishanchand's death in 1995," said a police officer. Kishanchand Thakur had a share of 31 per cent of the property when he died. His wife Mohna, two sons Rajeev, Ashish and daughter Priya became the legal heirs and each of them got a share of 7.1 per cent of the shares held by him.

Motwani has been insisting that they give him the power of attorney to develop the property. The property was initially leased by Thakur family to a car dealer and later in 2007 sold it to HDIL, the official added.
