MUMBAI: Questioning the high-decibel rhetoric of the Shiv Sena and the BJP on the state government's partial rejection of the Adarsh inquiry report, the MNS has said that both parties, which run the BMC in coalition, can initiate action against the scam accused under the Maharashtra Regional & Town Planning (MRTP) Act.

Sandeep Deshpande, the leader of the MNS in the BMC house, has written a letter to mayor Sunil Prabhu detailing how the ruling BMC combine has the powers to slap charges under the law.

"The inquiry report has said that the Adarsh accused can invite action under section 50 of the MRTP Act. But the state government is unwilling to go ahead and prosecute them. Nonetheless, the ruling combine in the BMC can very well do the needful as the violations have been committed in an area under the jurisdiction of the BMC," said Deshpande,

The Dadar corporator has urged the mayor to take up the matter with the municipal commissioner. "If the Sena-BJP combine really intends to ensure that justice is done in the Adarsh case and the wrongdoers punished, it must proceed with the MRTP Act, which it can use as the BMC is a local self-governing body. Let the state government take a different view," a senior political observer said. "But if the ruckus over the issue is just political posturing, the Sena-BJP combine, too, is liable to invite public criticism of playing to the gallery when it can do more than that."

Responding to the MNS letter, Sena leader Rahul Narekar said the civic body will not spare anyone who indulged in irregularities or was negligent in performing duties. "The Adarsh issue was subjudice. Hence, like everyone, we too were waiting for the findings of the judicial inquiry into the high-profile case. The report was tabled last week in the legislative assembly. So, it is too early to jump to the conclusion that the Sena-BJP alliance just wants to make it into a political issue and not take the matter to its logical end," he said. "Our legal experts will examine the report and the alliance will accordingly take action."

Taking a dig at the MNS for "politicizing the issue", Narvekar said, "Instead of writing a letter to the mayor, Deshpande or his party could have filed a complaint with the police."
