Fanil Popat, who runs a popular dairy in Palghar was accused in the murder of his wife Hiral on February 12, 2012. Fanil was lodged in the Thane central jail as his bail was rejected on four earlier occasions.
Sessions judge V S Dixit granted bail to Fanil on the ground that the vaginal swab found on the victim's vagina did not match with the semen analysis of Fanil. He was released on a solvent surety of Rs 75,000.
Hiral was found in a pool of blood in her bedroom. She was found in a semi-nude condition. The Palghar police arrested Fanil. His father Narendra and brother Raunak were put through semen tests to establish whether the semen found on the victim's private parts matched that of theirs.
The Palghar police maintained before the court that all the three male members of the bungalow were the only ones who had access to the victim's room. Final's lawyer Sudhir Gupta told the court that as the semen sample found on the victim's private parts did not match that of Fanil, Narendra and Raunak, the killer could have been an outsider.
Gupta told the court that it could be a case of rape, murder and robbery as even jewellery was missing from the bedroom.
