In the complaint filed before the forum on January 11, 2012, Stuti Gupta alleged that she sent some gems worth Rs 39,200 through the courier company to one Shashi Kapoor in Delhi. The courier was sent on June 16, 2010. But on June 19, 2010, when Kapoor received the courier, he realized that the gem stones were missing. Gupta made several attempts to get in touch with the courier company but no contact could be established with it. Finally, she filed a complaint with the Juhu police on June 23, 2010. Cops then summoned the owner of the courier company but they could not make any headway in the case.
Gupta then sent the courier company a legal notice seeking compensation. Once again, she got no response. Aggrieved, Gupta filed the complaint in the forum. The forum sent the courier firm a notice, asking it to be present in the forum and submit its side of the case. But despite receiving the notice, the firm did not make a representation in the forum. The forum then pass ed the order ex parte.
In the forum, Gupta submitted the courier service bill as evidence. She also produced the legal notice and a copy of the police complaint. The forum took into consideration the fact that Gupta had sent a sealed packet containing the gem stones to Kapoor. The forum observed that during the transit, the packet was either handled by the owner or its worker and it was they who removed the gems and handed over the empty packet to Kapoor. The forum said the firm had acted irresponsibly.
