HC tells state govt to examine book 'inciting hatred'

MUMBAI: Bombay high court on Tuesday directed the state government to examine and take necessary action on a public interest litigation that prayed for forfeiture of a book allegedly aimed at inciting hatred against Hinduism and a certain section of the Hindu community.

A division bench of Justice A M Khanwilkar and Justice K K Tated heard a public interest litigation filed by Dilip Aloni pointing out that the book 'Bahujan Hitay' by Purushottam Khedekar is inflammatory and defamatory.

His petition said in the guise of propagating secular ideology, the author has distorted history and alleged mala fide against Hindu saints and leaders.

He urged the court to direct the authorities to initiate appropriate action for forfeiture of the book and for criminal proceedings against the author and publisher under section 95 (power to declare certain publications forfeited and to issue search warrant for the same) of the Criminal Procedure Code.

Aloni's advocate Sanjiv Punalekar argued that the book was provocative and must be banned.

Additional government pleader Aruna Pai sought time for the authorities to look into whether Section 95 can be applied. However, the judges disposed of the PIL directing the Home Department to examine the issue and take appropriate action in accordance with law within four weeks.
