Partial relief for accused in Wadia deposition

MUMBAI: The sessions court has in a conditional order rejected a plea made by Kirti Ambani for an in-camera deposition by industrialist Nusli Wadia as a witness in a 25-yearold case of a murder attempt on his life. The court has imposed certain conditions on media reporting of the deposition. It has directed that any reference to business rivalry of the companies with respect to the present case made during the deposition cannot be reported when it takes place in the open court.

The court will next month fix a date for Wadia's deposition as a witness.

The case, which dates back to an alleged attempt made in 1988-89 on Wadia's life, has Kirti Ambani, then a senior executive at Reliance Industries Ltd (RIL) as a prime accused. According to the chargesheet, Wadia said Kirti used to then report to the company honcho, Mukesh Ambani, directly .

Late last year, the sessions court allowed Wadia's application to be allowed to testify as a witness. Wadia said he wanted to depose on the alleged motive and "larger conspiracy" behind the alleged murder attempt.

The CBI had dropped Wadia as its prosecution witness after first summoning him. But Wadia's counsel Mahesh Jethmalani argued that his testimony is crucial to understand the conspiracy . CBI questioned the delay, but had no objection.

In his earlier court arguments, Amit Desai, Ambani's counsel, had said Wadia's plea was "belated" and appeared to have an "ulterior motive" and allowing his deposition when all witnesses had already testified would violate the right to free and speedy trial of the accused.--Swati Deshpande
