The court remarked that while the petitioner, Samir Zaveri, who was represented by his advocate Rajiv Singh, could challenge the policy with on the cess, it advised the railways to reconsider its decision.
The government faced the court's ire after it had claimed that it provided ambulance services at 38 stations under the 108 scheme. But inspection of some stations by assistant registrars on court orders found that these were shared facilities. The ambulances had basic life support facilities, and not advanced life support equipment. "If this is the concept of providing facility for lakhs of commuters, what is the use of providing it?'' asked the court. It directed the state to continue providing ambulance services at the stations for the six months it would take to set up rooms and told it to consider vehicles with advanced systems.
The HC has scheduled the next hearing on December 24, and has told the railways to file its affidavit.
