The interim stay however brings little relief since the Bombay high court had last month granted a stay only till July 14 to Khan who was in January convicted by a magistrate for being an illegal resident in India without proper documents. The magistrate had sentenced him to six months in jail, a sentence he served and the Deputy Commissioner of Police SB(II) branch passed detention orders against him pending his deportation.
He received deportation orders for being a Pakistani national residing illegally in India for almost two decades.
Siraj's wife moved the HC for relief with the help of a social activist Imran Khan in May. The HC while giving temporary protection had asked him to appeal the magistrate's order which he did this month and the sessions court admitted it and placed it for final hearing next on September 4.
Khan, meanwhile, is still in police custody. His appeal says the order makes him out to be a Pakistani Nationalthough he hails from POK. He said due to improper legal guidance he completed his sentence even thought it is a ''blemish'' on his reputation and wants it set aside.
