The police said Setalvad had "embezzled funds'' collected in the name of the 2002 Godhra riot victims.
Setalvad and Anand had challenged before the Bombay high court against an FIR filed by the Gujarat police.
Earlier the high court had asked her to file for anticipatory bail before a Gujarat sessions court after giving her transit protection.
The FIR said that both the accused in the guise of collecting funds in the name of their NGO Sabrang Trust to set up a museum for victims of the 2002 communal riots in Gujarat at the site of Gulbarga Housing Society had allegedly misappropriated the funds and cheated the complainant. The FIR also invoked Section 72A of the Information Technology Act for disclosure in breach of lawful contract.
Setalvad said the FIR filed by the Crime Branch of the Ahmedabad police was false and filed with malafide intent to intimidate them. "This is the fifth time that a false criminal case has been lodged since 2004 because of me and my organisation's consistent legal support to the victims of 2002 riots," her plea in the high court said. "Gulbarga cooperative housing society had been totally burnt down by politically motivated anti-social elements and 68 people had lost their lives during the massacre."
"The Citizens for Justice and Peace trust received Rs 4.97 crore as foreign funds from February 2004, when it was registered, till January 2014. The Sabrang Trust, which was registered in April 2007, has received Rs 2.63 crore as funds from foreign till February 2014," the affidavit now filed by K N Patel, assistant commissioner of police, Ahmedabad Crime Branch said.
