Mumbai: The Bombay high court on Monday asked Ashish Khetan to cite authorities that permit him to file an intervention plea in an appeal in a criminal case.
The HC bench headed by Justice P V Hardas gave Khetan time till October 29 and adjourned till then the death confirmation case of Himayat Beig who was convicted and sentenced to the gallows in the German Bakery blasts of 2010 in Pune.
The HC suggested he had other remedies.
Khetan, a scribe, said he had later spoken to the three crucial witnesses whose deposition had nailed Beig. They also later said that they were forced to depose against Beig.
His counsel Mihir Desai said as a responsible citizen he was bringing it to the notice of the high court where the confirmation case is pending and that he was merely asking the court to consider the sting operation recordings and the changed statement of the witness to consider if they are true, in the larger interest of justice.
The evidence that went against Beig was that he has jihadi mentality, that RDX was recovered from his house and that he was seen getting off an autorickshaw.
The witnesses apparently told Khetan that they were coerced into deposing even when one of them said the RDX "was planted" and another witness said Beig was with him when he was supposed to have been "spotted in a rickshaw".
Counsel Mehmood Pracha and advocate I A Khan for Beig said every citizen had a right to bring any cognizable offence to the notice of a police station.
