No political banners during Navratri: BMC tells HC

MUMBAI: Brihanmumbai Municipal Corporation has told Bombay high court that it has banned political hoardings and banners from being displayed during the ensuing Navratri festival. The court was also told on anvil is a comprehensive policy for hoardings in festivals.

A division bench of chief justice Mohit Shah and Justice M S Sanklecha on October 4, 2013 heard an application by Janhit Manch highlighting the civic body's callousness in enforcing the ban on illegal hoardings/banners despite judgments delivered by the court as late as March 2013. Its convenor Bhagwanji Rayani argued that during Ganeshotsav not a single signal in Mumbai's suburbs was left without banners.

The judges asked BMC's senior counsel Anil Sakhare and advocate Joel Carlos if there are guidelines for regulating hoardings. Sakhare replied that BMC has come out with specific guidelines for Navratri this year and hoardings and banners put up by politicians, party workers and party including welcome greetings are banned. He said the size of the hoarding/banners permitted is not more than 10x10 feet and gutka, tobacco and liquor advertisements are also banned.

Sakhare said on the same lines, a comprehensive policy for festivals has been framed for all temporary hoardings other than commercial and its draft guidelines will be placed before BMC's General Body within a month for approval. "We'll try to enforce it strongly. All parties are respondents and if brought before the court, a major problem will be solved," said Sakhare, adding that civic staff faces resistance, Rayani said BMC is forever changing its guidelines for hoardings and questioned how the general body consisting of 227 political members can act against their own interest and approve the guidelines. If the law gives them power to do so, we cannot that away that power," said Justice Shah.

To a query, Sakhare replied that the licence department is responsible for implementing the guidelines. He said in every ward there are two officers assisted by staff. "Staff strength requires attention," he added, saying while one officer issues licence permits the other officer goes on field with staff. "The judges said the staff is sufficient to regulate hoardings. If it is illegal, pull it down," said Justice Shah. The next hearing is on November 21,2013.
