MUMBAI : Bombay high court has given Brihanmumbai Municipal Corporation futher time till this month end to decide applications by the police to regularise illegal beat chowkies across Mumbai.
A division bench of Justice A M Khanwilkar and Justice A P Bhangale on March 7, 2013 heard a public interest litigation by I K Chhuganiregarding illegal police beat chowkies erected on footpaths or obstructing roads and sponsored by private parties. HC on October 24, 2007 had directed their demolition. The Supreme Court subsequently directed a status quo.
Anaffidavit by Joint Commissioner of Police (Administration) Hemant Nagrale said there are 252 illegal chowkies in Mumbai out which 61 have been demolished. The court was informed by the additional government pleader that of the remaining 191 chowkies , there is data available in respect of 125 chowkies and police is in the process of collecting data in respect of the remaining 66 chowkies. Questioning the delay the judges had directed that senior inspectors of police stations in areas where such illegal chowkies are erected , if they have not applied, should apply to BMC to regularise them within two weeks,
BMC advocate urged for time to decide on the applications for regularisation. The judges granted time till March 30, 2013 and asked BMC to file a compliance report at the next hearing on April 1, 2013.
