HC acquits woman of double murder of children

MUMBAI: The Bombay high court acquitted a 30-year-old housewife from Sangli who sentenced to life imprisonment on charges of murdering two children including her son.

False implication cannot be ruled out. Hence, it can be safely inferred that the prosecution has failed to establish the guilt of the accused,'' said a division bench of Justice Vijaya kapse-Tahilramani and justice Sadhna Jadhav. The court also dismissed an application filed by the state seeking the death penalty for the woman accused Seema Jadhav (name changed).

The prosecution claimed that Seema had killed the son of a relative, from whom she had borrowed a necklace. She then killed her own son, who had witnessed the murder. The court however held that the prosecution had failed to establish death of the children on the dates alleged by witnesses. The court pointed out that the doctor had opined that the deaths could not be proved as the bodies had been highly decomposed. However, according to the police the accused's son had made a dying declaration to his father. the court observed that this was humanly impossible. The court also questioned the delay in filing the FIR.
