Child access: HC to frame new guidelines

MUMBAI: The Bombay high court (HC) on Wednesday said it is in the process of framing fresh guidelines for grant of access of minor children in custody battles between parents.

The court heard a PIL by Kishwar Mirza, highlighting non-implementation of guidelines by Child Rights Foundation which were circulated by the HC in 2011 to family courts and marriage counsellors across the state.

The PIL states that subjecting non-custodian parents to meet children in a "classroom- sized children complex" exposes children to a litigating environment and leads to increased levels of stress and depression.

A bench of Justice V M Kanade and Justice A R Joshi was submitted photographs by Mirza's advocate Shehzad Naqvi showing how meetings are held in the children's complex at the Family Court in Bandra. A non-custodian mother was allowed to intervene in the matter after she submitted that suggestions of TISS also be considered. Welcoming suggestions, the HC said the same may be given to the court at the next hearing.
