The forum said that the complainant, Santosh Pathak was also entitled to get interest on the amount at the rate of nine percent per annum from the date of transfer of the said amount till the amount is credited to his account. "For getting such relief the complainant was required to knock the door of consumer forum and naturally he suffered mental agony and physical harassment because of the said act of the opponent," the Maharashtra State Consumer Disputes Commission said.
Pathak had filed an appeal before the commission in 2011 after being aggrieved by a district forum order that dismissed his complaint. Pathak said that he the money was credited into the account of a woman who was also an account holder in the bank/ when he noticed the transfer, he immediately contacted the bank but got no reply.
The bank eventually told him that the transfer was done as per his telephonic instructions. However, Pathak denied that any such instructions were given and requested the bank to credit the amount back to his account. When the bank failed to do so, Pathak filed the complaint before the forum in 2006.
