A progress report was submitted to a division bench of Justice Abhay Oka and Justice Anil Menon by IT's advocate N N Singh on January 12, 2015. The report stated that during the course of assessment proceedings for 2007-8, the six were summoned and their statements recorded.. ``It is admitted by all the abov persons that they have given loan to Dr. Vijaykumar K Gavit, Nandurbar and same is shown in their books of account,'' it stated, adding that they have been requested to produce books of account for verification. The Department has stated that it will complete its proceedings against the minister, his wife Kumudini and brothers Sharad and Rajendra before they get time-barred.
The court is hearing a public interest litigation by Nashik activists for prosecution of Gavit, his wife Kumudini and brother Sharad for disproportionate assets.under Prevention of Corruption Act, Income Tax Act and Indian Penal Code and probe by a special investigation team. The PIL alleged that ``illegal assets '' were acquired by Gavit when he was minister of the Tribal Development Department, a portfolio he held for a long time.
The ACB is already conducting its open inquiry. The bench after perusing its status report on January 12, 2015 noted that ``substantial steps have been taken to conduct the (open ) inquiry.'' It has been directed to submit its report on March 24.
