MUMBAI : The Central government is expected to tell the Bombay High Court early next week if it has taken a decision to ban national flags made of plastic.
On September 29, the HC had directed the Centre to take a decision as expeditiously as possible and preferably before November 30 so that it can be implemented before Republic Day. The matter is slated to be heard on December 8.
A division bench of Justice Abhay Oka and Justice Girish Kulkarni heard a public interest litigation by Hindu Janjagriti Sangh saying the State government is doing nothing despite issuing a August 22, 2007 circular banning the use, sale and purchase of such flags. The PIL said after Republic Day and Independence Day flags are found on roads and gutters and its has collected many of them.
Centre's affidavit said there is no legislation banning manufacture of plastic flags but there is a proposal to do so. The judges said the National Flag Code of India does not contemplate use of plastic flags and while allowing paper flags has provided for their disposal in private consistent with the dignity of the flag.
They rapped the State government for not complying with the earlier order to direct institutions to ensure that plastic flags are not used and also not made arrangements for their disposal. They directed it to issue circular to all departments and educational institutions to ensure that no one shall use flags made of plastic'' and give wide publicity to it. They also directed that collectors and tehsildars will collect flags for disposal.
