On July 25, the court was informed that of the 63 witness statements, only seven original copies were available. While submitting the documents, Gharat said that the statement of one of the witnesses, who has already deposed, was the only document missing. The witness was the manager of Rain Bar, where the prosecution alleged Khan had drinks just before the incident. Gharat also told the court that an inquiry has been conducted by an officer of the rank of assistant commissioner of police on how the papers went missing and a report will be submitted before the court.
Meanwhile, defence advocate Srikant Shivde sought a list of the witnesses and the schedule when they were going to be examined. When Gharat opposed this, Shivde said, "Let us not convert prosecution into persecution. They can't play hide and seek with the defence." The court then directed the prosecution to let the defence know about the witnesses scheduled to be examined within reasonable time. Shivde also sought submission of the case diary, which was also claimed to be missing at the last hearing in August.
