Justice Gautam Patel will decide on a suit filed by Khuzema Qutbuddin, the uncle of the incumbent Syedna Muffadal Saifuddin, to declare him as the 53rd Dai-al-Mutlaq or spiritual head. Qutbuddin claimes he was privately anointed by his half-brother - the late Syedna Mohammed Burhanuddin in December 1965 and asked to reveal it at an appropriate time.
The issues framed included on the point of jurisdiction with regard to properties attached to the office of the Syedna, on the requirement of a validness and whether Qutbuddin proves validness was conferred/pronounced on him as stated in his plaint. The suit will be next heard on October 14 to fix the schedule.
