The case was registered after Supreme Court ordered an election officer to file a case against Kathore, dismissing his plea of challenging the order of Bombay high court that cancelled his 2004 assembly election nomination.
The Bombay high court, on August 17, 2007, cancelled the 2004 election of Ambernath MLA Kathore on the ground of submitting false affidavits while filing his nomination papers. Kathore had won the election against Shiv Sena candidate Sabir Shaikh.
RTI activist Arun Sawant had challenged Kathore's election in the Bombay high court.
On Saturday, on the complaint of election officer Ashok Shingare, Shivaji Nagar police in Ambernath filed the NC against Kathore under Section 177 (furnishing false information) of IPC.
However, law experts believe that the court order will not affect Kathore's current MLA post from Murbad constituency which he won in the 2009 assembly election.
An advocate involved in such cases not wishing not to be named claimed that, "The challenge was given to the 2004 election result and the term of that assembly ended in September 2009.
Therefore, in case Kathore's disqualification is upheld, it will not be applicable for his existing term."
The advocate further said that, "Kathore won the election from Ambernath constituency in 2004 while he won the 2009 election from Murbad constituency."
