Hearing a public interest litigation, a division bench of Justice Abhay Oka and Justice A S Chandurkar was miffed that despite setting a deadline of June 30, the appointment of 216 protection officers (POs) at the taluka level was not done.
The department had objected to appointing POs at the taluka level saying it was "avoidable fiscal burden" and that cases filed there are "negligible".
Government advocate Abhinandan Vagyani said recruitment rules for taluka-level appointments were yet to be framed.
The judges asked why it was not done earlier. "Now you are coming out with excuses, that there are no rules," Justice Oka said.
The judges observed that the act had come into force in October 2006.
"It's almost eight years," Justice Oka said. "This shows the intention of the government that the Domestic Violence Act must not be implemented."
The judges also said that they would issue contempt of court notice to the chief secretary, but on a plea by Vagyani they granted him time till Tuesday to take instructions.
