Bombay HC acquits Thane youth facing death in rape-murder case

MUMBAI: A Thane youth sentenced to death in an eight-year-old girl's rape and murder case was acquitted by the Bombay high court on Friday.

Setting aside the death sentence awarded to Chandrashekhar Gupta (26) by a lower court, a division bench of Justice Vijaya Kapse-Tahilramani and Justice V L Achliya cited lack of evidence to link him with the crime.

The prosecution said it would challenge the verdict in the Supreme Court.

On December 24, 2009, the victim had gone missing from Vartak Nagar in Thane, where she used to reside.

The next day her body was found at the police firing range in the area.

The police arrested Gupta and charged him with rape and murder. In May last year, a Thane sessions court held that Gupta's crimes fell in the category of rarest of rare and awarded capital punishment.

The prosecution case rested entirely on circumstantial evidence. Witnesses claimed that the victim was last seen with Gupta.

The police said Gupta's trousers and underwear were stained with blood and he had injuries on his body.
