Thane court convicts five perpetrators in sex trafficking case

MUMBAI: Sixteen trafficking victims received justice in a four year old case on December 6. A sessions court in Thane, near Mumbai, convicted five perpetrators who sexually exploited these girls for commercial gain. Four accused were acquitted.

The case started on July 3, 2009 when police officers from CBD Belapur (Crime Branch) conducted a rescue operation at Hotel Diamond Palace in Nerul. The officers were supported by International Justice Mission (IJM), an anti-trafficking NGO. During this operation, they rescued 16 girls, including five minors, who had been forced to service clients at the hotel.

Three of the five convicts were pimps (Amjad @ Babu Mandal , Raj Dasharath Parida and Gayadhar @ Dipak Shahu). The court convicted them under the Immoral Trafficking (prevention) Act and the Indian Penal Code. The court sentenced them to five years' imprisonment for the IPC offences and to seven years for the ITPA charges. Two of the accused Gunakar Sinna Shetty and Prashant Vasant Shetty were convicted under Section 3 of ITPA and sentenced to one year in prison.

Commenting on the judgment, Michelle Mendonca, Director Legal, IJM said, "this verdict has proven yet again, that when the police, prosecutors and civil society work together, the weak and the powerless can receive justice and offenders will not return to business as usual. Unless these offenders are convicted they will continue to exploit other young girls leading to a never-ending cycle of abuse."

After their rescue in 2009, the girls were placed in respective aftercare homes where they could recover from their traumatic ordeal. The girls trafficked from neighboring Bangladesh were repatriated, and those from different parts of India have returned to their families in their home states. Two of the rescued minors briefly returned to Mumbai to testify in court against their oppressors.
