MUMBAI: The state government informed Justice S J Kathawalla of the Bombay high court recently that pursuant to the order passed by the HC on December 18, 2013 the demarcation work on the plots in Thane occupied by Mafatlal Engineering Industries has begun. The state lawyer G W Mattos sought time from the HC to submit his report over the progress made by the authorities in the demarcation work.
The work started on January 7, 2014, said Mattos.
Justice Kathawalla thus granted time and adjourned the matter to January 24 when he said the first interim reports shall be submitted in the HC.
The Bombay high court had in December directed the ThaneSub Divisional Officer to identify how much area of the Mafatlal engineering industries ltd belongs to the state and how much to the company. The HC directions came on a plea made by the company workers who have been fighting for decades for their unpaid dues which they say amount to over Rs 400 crore.
Advocate A Ramakrishna appearing for the workers had said that the state has been ''dragging its feet'' for years and not demarcating the company's land. Once demarcated the company's landcould be sold off to pay the workers dues. He said of the 3600 factory employees, 1500 had died over the years, even as their dues remained unpaid.
The company which closed down in 1989 was housed on a 197 hectare spread in Kalwa, in Thanedistrict. It had bought landfrom farmers, but a major portion of the company's landwas acquired for it as industrial landby the state in the early 1950s said the government lawyer GW Mattos. The state said for various breach of conditions by the company, the state took back possession of about 26 hectare of its land.
The assistant government pleader Mattos also undertook to forthwith forward a an earlier order to the District Judge,Thane. Justice Kathawalla accepted the undertaking. Meanwhile the lawyer for the Thane Municipal Corporation undertook to comply with the directions recorded by the HC last April.
