No complaint against mob which attacked Nigerian citizen

MUMBAI: While the 28-year-old Nigerian, Onouha William Lucky, was sent to 14-day custody on Tuesday for assaulting a cobbler in Vashi, police have not registered any complaint against the mob of over 100 people who had attacked the Nigerian.

It was practically a free-for-all outside Vashi railway station on Monday afternoon as the mob had surrounded Lucky and started slapping and punching him after his initial fight with the cobbler, Sheshrao Purbe, over Rs 5.

Vashi police have only registered the complaint of Purbe against the Nigerian under sections 325 (causing grievous hurt), 323 (causing hurt) and 504 (intentional insult to provoke breach of peace) of the Indian Penal Code. However, some of the independent lawyers that TOI spoke to opined that a counter complaint of the Nigerian against unidentified persons in the mob should also have been.

It is a poor reflection of the law and order situation as an angry mob continued to beat a foreigner for over 15 minutes and also tore off his clothes. The police only arrived after 15 minutes to take away the Nigerian and the cobbler,'' said an eyewitness and Navi Mumbai based builder, Nitin Kandhari.

RTI activist and lawyer, Vinod Gangwal, commented: Although it was wrong on part of the Nigerian to hit the cobbler, it was equally wrong on part of the mob to badly beat up the Nigerian and tear his clothes. Therefore, he too has the right to lodge a complaint against the mob, but Vashi police has not done so.''

Gangwal added that it is strange why the police did not immediately reach the spot, since the police beat chowky is only a stone's throw away, opposite Centre One mall.

Had the police not delayed by 15 minutes, there would not have been any mob attack on the Nigerian, and subsequently on the TOI photographer who was simply clicking photos of the mob violence. It is a shame that in such a developed and busy location of Vashi, law and order went for a toss,'' added Gangwal.

TOI photographer, K K Choudhary, was attacked by a few persons from the same mob which was hitting the Nigerian, as they were afraid that their illegal act will be caught on camera and published in the newspaper.

The senior inspector of Vashi police, Laxman Kale, merely said: Only the Nigerian has been made an accused for first assaulting the cobbler; that's why he has been sent to judicial remand. With regards to the assault on photographer, an NC (non-cognizable complaint) has been registered.''

When contacted, the deputy commissioner of police (zone 1) Purushottam Karad, said that he will inquire into the matter with Vashi police.

Meanwhile, the cobbler, Purbe, told TOI that the municipal hospital at Vashi have recommended an x-ray of his three front teeth which were affected after he was punched by the Nigerian. Purbe's medical report states that his front teeth are showing 'Grade 1 mobility' (slight loosening due to the fight).
