High court stays trial in murder case

MUMBAI: Bombay high court has stayed the ongoing trial at the Kalyan sessions court and also the appointment of special public prosecutor while hearing an application which alleged that the prosecutor is appearing for the accused in a cross case pertaining to the same incident.

A division bench of Justice P V Hardas and Justice A R Joshi on April 3, 2013 heard an application by Mahendra Bhoir who is facing murder charges. One person was killed after Bhoir allegedly fired at a mob which set a dumper on fire outside a petrol pump owned by him. Advocate Anant Patki was appointed as SPP on the request of mother of the deceased.

Bhoir sought the quashing of Patki's appointment, pointing out that he is appearing for the accused in a cross case filed by him and which is conducted before the same court simultaneously. The judges questioned how Patki would be appointed as SPP if he is appearing as private advocate. Staying his appointment and the trial, they postponed the final hearing by four weeks.
