MUMBAI: A day after the landmark order of the Bombay high court, chief minister Prithviraj Chavan is facing a piquant situation. In view of the specific directions, Chavan will have to decide whether to grant permission for an open inquiry against senior NCP leader and public works minister Chhagan Bhujbal, veteran bureaucrats Ashok Lal and Laxmikant Deshmukh and legislator Ramprasad Bordikar.

While hearing a criminal PIL on Friday, a division bench comprising justices A M Khanwilkar and A P Bhangale asked all secretaries concerned to expedite the process of consideration of those proposals and that the proposals up to year 2011 are decided not later than two weeks from today. "It is noticed that proposals relating to year 2002 onwards are still pending, for reasons best known to the concerned department...as a second phase, the concerned department can take up the proposal pertaining to year 2012 to be disposed of within two weeks thereafter. Which means that by the middle of April, 2013, all old proposals will stand disposed of....later, proposals will have to be disposed of within three months from the date of receipt of the proposal,'' Justice Khanwilkar and Bhangale observed in their four-page order.

As per the official website of the anti-corruption bureau, of the 16 proposals, permission for conducting open inquiry against controversial bureaucrat Ashok Lal was sought on July 26, 2002. Then Lal was the CEO of the Mumbai housing board. Permission for conducting open inquiry against senior legislator Ramprasad Bordikar was sought on March 13, 2003, against Chhagan Bhujbal for his alleged involvement in the Maharashtra Sadan construction scam, on July 16, 2012; against J D Bhotange, the then director of vocational education, for allotment of land for the Nyay Sagar coop housing society, on October 20, 2012; against former Akola municipal commissioner Laxmikant Deshmukh on November 8, 2011 and senior bureaucrat Prakash Sabde, who was then managing director of a state-run corporation, on August 6, 2012 . "The competent authority will have take a decision on granting open probe in all those cases submitted before December 2011 before March 22, while in the remaining cases before April 10,'' a senior bureaucrat said.

Meanwhile, additional chief secretary (home) Amitabh Rajan has written to the anti-corruption DG, secretaries of all departments, DGP, heads of all civic and zilla parishad organisations to decide all the pending cases within the stipulated time.
