MUMBAI: Water expert Madhav Chitale, who heads the special investigation team (SIT) set up by the state to probe the alleged irregularities in irrigation projects, has said that the SIT does not have the authority to investigate officials involved in the scam.
The moment the SIT was constituted in January, Aam Aadmi Party( AAP) had declared that they had no faith in a body that had neither the requisite rights nor the moral standing to institute and inquiry.
Two weeks ago, Mayank Gandhi and Anjali Damania submitted a request to the Honorable Court to reconstitute the SIT as it is not as per law. The SIT does not have the power to prosecute nor summon as it has not been constituted under the Commissions of Inquiry Act, 1952 under which the Government officials have to compulsorily give statements on
oath to a panel formed under the COI Act.
Further, the SIT panel must function under the supervision of the Court and must be conferred with adequate powers as may be prescribed by Court.
