SC issues notice on SLP against appointments of varsity VCs in Maharashtra

MUMBAI: A former pro vice chancellor of Mumbai University A D Savant has moved the Supreme Court to challenge the appointments of vice-chancellors in several universities across Maharashtra including the Mumbai University. The SC bench of Justice R.M. Lodha, Justice Chelmeshwar Jasti and Justice Madan Lokur has now issued notice to various universities and vice-chancellors.

The challenge by Savant is on the ground that the appointments were contrary to the requirements laid down by the UGC.

In September 2009, UGC Regulations came into force and were gazetted in June 2010. They prescribed qualifications for the post of the vice-chancellors to be appointed in the various universities and the qualification for selection of the search committee, which would forward the list of the selected candidates to the chancellor — the governor of respective states — for final selection. The UGC regulations provided for 10 year experience as a professor for the post of Vice-Chancellor and it also recommended that one of the member of the search committee should be from UGC.

The State Commission, had amended section 12 (1) of the Maharashtra Universities Act, 1994 and provided qualification for appointment of Vice-Chancellor as well as search committee. Savant said these amendments were in breach of the UGC regulations and his case is that based on these amended rules, the search committee selected unqualified candidates as vice chancellors in several universities.

Savant who felt that many qualified candidates were thus bypassed filed two Special Leave Petitions in the SC-one last year and one this year — challenging orders passed last July by the Nagpur bench of the Bombay HC and by the Bombay HC. Though his lawyers Prashant Bhushan and Dilip Taur he challenged the amendment to section 12(1) of the Maharashtra Universities Act on the ground that, it is repugnant to the UGC Act. He also challenged the constitution of the search committee being contrary to the UGC Act and he sought the quashing of the amended section 12(1) and also the search committees appointed under the amended section.

Savant made Sant Gadgemaharaj University , Amravati , Dr. Babasaheb Ambedkar Marathwada University, Aurangabad , SNDT University Mumbai, vice-chancellors of Mumbai, Pune, Kolhapur , Lonare, Nagpur , Aurangabad , Nashik as a respondents and pleaded that all these appointment are contrary to the UGC Act.
