MUMBAI: The Central government and the President's office forgets, it appears, that sitting high court judges cannot be appointed as special government counsel too. It recently appointed two judges of the Bombay high court, Justices Nitin Jamdar and Manoj Sanklecha as counsel on a panel to represent the Central government before the high court.
The law ministry, in a notification signed by Suresh Chandra, joint secretary and legal advisor to government of India, has retained names of two Bombay high court judges in the special panel of counsels for Union of India.The notification extended from January 1, 2013, the terms of 32 special counsel, 55 senior counsels in group I and 18 in group II, five junior counsel for Bombay high court in Mumbai and several others for its benches in Aurangabad, Nagpur and also for the Central Administrative Tribunals till February 15 this year. The notification is dated December 31, 2012 while both the HC judges who earlier were empanelled counsels were elevated and appointed as judges last January.
The new notification which has been copied to over 50 government officers and authorities including the department meant to translate it into Hindi, shows how ''lackadaisical and lazy'' the government departments are in their approach said a lawyer in Mumbai. Justice Jamdar's name reflects as a special counsel and Justice Sanklecha is shown as senior counsel group I for the Central government matters. Both are at present handling matters that do involve the Centre and various central ministries, but as judges and decision makers.
