Two months of custody for "rape", doctor gets bail

MUMBAI: The Bombay high court on Tuesday granted bail to a doctor from south Mumbai accused by a married US-based woman four years after. The woman's husband had filed a private complaint with a Mumbai magistrate against him of adultery before she filed an FIR with the Colaba police station in August and he was arrested immediately. Justice Abhay Thipsay granted a bail of Rs 30,000 with two sureties after advocate Aabad Ponda who appeared for the alleged victim and complainant "in all fairness" as the judge observed did not oppose the bail plea of the man.

The man, a 38-year-old MBBS graduate from Manipal University who is now studying Ayurveda medicine in Pune was accused by the same-aged woman of raping her after offering her a spiked rose-milk drink and making her believe she was his "divine consort" and had several times had physical relations with her in India in 2007-08. His counsel Amit Desai said the entire FIR is concocted as a "vendetta" by a "woman scorned" who had accused the doctor of wanting to marry her after she divorced her husband with who she resided in California since their marriage in mid 1990s. She had made no efforts to initiate divorce he said. He said bail must be given on merits. The judge noted that the FIR was lodged after a delay of four years after the "last incident between the parties".

The doctor has already spent 65 days in custody and Ponda said he had opposed bail earlier to see if stupefying substance could be recovered. But now there was no such requirement. The public prosecutor said probe will be over in 15 days and the chargesheet will soon be filed and his passport is already seized by the police. The judge said after considering all facts and the delay in FIR, bail be granted with a condition that he present himself before Colaba police whenever required.
